I HAVE RECEIVED AN INFRACTION (A TICKET). WHAT ARE MY OPTIONS?

You have the options listed below. Make sure to file your response with the court within 30 days of receiving the infraction (33 days if received by mail) or your license may be suspended. We recommend you copy or take a photo of your ticket before you file or return it to the court. 

PAY YOUR INFRACTION IN FULL

You may pay your infraction in full online, by mail, by phone, or in person. If you would like to setup a payment plan or ask to do community service instead of paying the fine, please contact the District Court office. CONTEST HEARING IN PERSON, BY MAIL OR BY EMAIL

A contested hearing is a hearing where a person challenges an infraction by presenting evidence.  You have the option of a contested hearing in person, virtually, by mail or by email. Check the box on the ticket for contested hearing, put your mailing address, email, and phone number where the ticket asks for it, and return the ticket to the District Court office by mail or in person. If you choose the mail or email options, you do not need to appear in court. Instead, you must complete the Contesting of Infraction by Mail/Email form and mail or email it to the District Court email. Your form and any evidence you want to present must be received before your scheduled hearing (if one has been set).  The judge will review what you provide as well as the law enforcement officer’s sworn statement and any evidence and make a decision. You will be notified of the judge’s decision.  

MITIGATION HEARING IN PERSON, BY MAIL OR BY EMAIL

A mitigation hearing is where a person admits to committing an infraction but wants to explain the circumstances in the hope of having the fine reduced. You also have the option of a mitigation hearing in person, virtually, by mail or by email. Check the box on the ticket for a mitigation hearing, put your mailing address, email, and phone number where the ticket asks for it, and return the ticket to the District Court office by mail or in person. For the mail or email option, you must complete the Mitigation of Infraction by Mail/Email form and mail or email it to the District Court email. Your form must be received before your scheduled hearing (if one has been set). The judge will consider your explanation for committing the infraction and make a decision about whether to reduce the fine.  You will be notified of the judge’s decision if you chose the mail or email option.

DEFERRED FINDING

A deferred finding allows you to keep the infraction off your driving record. If you have not had a deferred finding within the past seven years and do not have a commercial driver’s license (CDL), you may be eligible for this option. If the judge grants a deferral, your case will be continued for 12 months on the condition that you 1. are not cited for an infraction (or a criminal driving offense) during the deferral period, and 2. pay the infraction penalty amount plus $25 administrative fee. If you comply with the conditions, the infraction will be dismissed. Simply complete the Petition for Deferred Finding form and request a deferral. IF YOU FAIL TO RESPOND TO YOUR TRAFFIC INFRACTION WITHIN 30/33 DAYS:

1. EACH INFRACTION WILL BE FOUND COMMITTED AND FULL FINE ASSESSED.
2. A $52 PENALTY WILL BE ADDED.
3. THE VIOLATION MAY BE REPORTED TO THE DEPARTMENT OF LICENSING AND MAY RESULT IN THE SUSPENSION OF YOUR PRIVILEGE TO DRIVE.
4. UNPAID FINES MAY RESULT IN REFERRAL TO A COLLECTION AGENCY, AND/OR GARNISHMENT OF WAGES OR OTHER ASSETS.
